Article 1: Purpose
These terms and conditions aim to specify the detailed implementation and compliance requirements of the domestic travel contract between “Art Around” (hereinafter referred to as "the Agency") and the traveler.
Article 2: Purpose
① The Agency must diligently perform its duties, such as arranging travel, providing guidance, transportation, accommodation, and creating and executing the travel plan to ensure a safe and satisfactory travel experience for the traveler.
② The traveler must cooperate actively in maintaining harmony with other travelers and in upholding travel order to ensure a safe and enjoyable trip.
Article 3: Types and Definitions of Travel
The types and definitions of travel are as follows:
① The Agency must diligently perform its duties in providing safe and satisfactory travel services, including travel arrangements, guidance, transportation, accommodation, and planning and executing the travel schedule.
② The traveler must cooperate in maintaining harmony with fellow travelers and help uphold travel order to ensure a safe and enjoyable journey.
Article 4: Components of the Contract
① The travel contract consists of the travel contract document (attachment), terms and conditions, and the travel itinerary (or travel description).
② The travel itinerary (or travel description) must include travel destinations, tourist content, transportation methods, the number of shopping stops, accommodation locations, meals, and other services provided by the Agency, along with traveler precautions.
Article 5: Special Provisions
The Agency and traveler may enter into special agreements in writing within the scope of applicable laws. In this case, the Agency must explain the differences from the standard terms and conditions to the traveler.
Article 6: Delivery of Contract Documents and Terms
If the Agency enters into a travel contract with the traveler, the Agency must provide one copy each of the contract document, terms and conditions, and travel itinerary (or travel description) to the traveler.
Article 7: Delivery of Contract Documents and Terms Considered Delivered
The following cases are considered as the Agency delivering the travel contract document, terms, and travel itinerary (or travel description) to the traveler:
1. When the traveler agrees to the contents of the travel contract, terms, and itinerary (or description) provided through the internet or other electronic networks and the Agency notifies the traveler of the acceptance of the contract.
2. When the traveler agrees to the contents of the travel contract, terms, and itinerary (or description) provided by fax or other mechanical devices, and the Agency notifies the traveler of the acceptance of the contract.
Article 8: Responsibilities of the Agency
① The Agency is responsible for any damage caused to the traveler by the Agency, its employees, or local agents due to intentional or negligent acts related to the duties outlined in Article 2, paragraph 1, from the departure to the arrival of the trip.
② The Agency is responsible for any damage suffered by the traveler due to delayed or missed transportation (airplane, train, ship, etc.), unless the Agency proves there was no negligence or intentional fault.
③ The Agency is responsible for any damage caused to the traveler’s baggage, such as loss, damage, or delay, unless the Agency can prove it did not neglect the duty of care in handling the baggage.
Article 9: Cancellation of the Contract due to Insufficient Minimum Participants
① The Agency must notify the traveler within 24 hours before departure for a one-day trip, or within 48 hours for a trip lasting one or more nights if the minimum number of participants is not met, resulting in the cancellation of the trip.
② If the Agency cancels the contract without notifying the traveler within the above timeframe, the Agency must refund the deposit received and compensate the traveler for 100% of the deposit amount.
Article 10: Refusal of Contract Conclusion
The Agency may refuse to conclude a contract with the traveler if any of the following conditions are met:
1. If the traveler disrupts or causes harm to other travelers or the smooth conduct of the trip.
2. If the traveler is deemed unable to travel due to illness or other reasons.
3. If the maximum number of participants as stated in the contract is exceeded.
Article 11: Travel Fees
① The travel fee in the travel contract includes the following items, unless otherwise agreed upon between the parties:
1. Fare for transportation (airlines, ships, trains, etc.) based on regular fares.
2. Transportation fees between the airport, station, port, and hotels.
3. Accommodation fees and meal costs.
4. Guide fees.
5. Various taxes required during the trip.
6. Domestic airport and port usage fees.
7. Admission fees to tourist attractions listed in the itinerary.
8. Other costs based on individual agreements.
② The traveler must pay the deposit (not exceeding 10% of the travel fee) to the Agency upon contract signing. The deposit will be considered part of the travel fee or compensation.
③ The traveler must pay the remaining balance (excluding the deposit) to the Agency by the day before departure.
④ The traveler must pay the travel fees through the methods agreed upon by the parties, such as credit card, bank transfer, or cash deposit.
⑤ If the desired travel fee includes insurance, the Agency must explain the insurance details, including the insurance company and coverage, to the traveler.
Article 12: Conditions for Changing Travel Terms and Settlement of Fees
① The travel conditions outlined in Articles 1 through 11 may only be changed under the following circumstances:
1. If both parties agree that a change is unavoidable for the safety and protection of the traveler, either upon the traveler's request or due to local circumstances.
2. If the travel objective cannot be achieved due to natural disasters, war, government orders, strikes, or closures of transportation or accommodation providers.
② If there is a change in travel conditions as per paragraph 1 that results in an increase or decrease in the travel fee stated in Article 11, the adjustment (refund) must be made as follows:
- For changes made before the departure, the adjustment must be made prior to the departure. - For changes made during the trip, the adjustment must be made within 10 days after the trip ends.
③ If the travel conditions are changed without following the provisions of paragraph 1, or if damages arise due to the termination or cancellation of the contract under Articles 13 or 14, the settlement (refund) must be made as follows:
- For damages occurring before the departure, settlement must be made before the departure. - For damages occurring during the trip, settlement must be made within 10 days after the trip ends.
④ If the traveler is unable to receive services such as accommodation, meals, or sightseeing during the trip due to personal reasons after departure, they cannot claim a refund from the agency. However, if the trip is terminated early, it will be handled according to Article 14.
Article 13: Cancellation of Contract Before Departure
① The travel agency or the traveler may cancel the travel contract before the trip begins. In this case, the damages incurred will be compensated according to the ‘Consumer Dispute Resolution Guidelines’ (Fair Trade Commission Notice).
② The travel agency or the traveler may cancel the contract without paying damages to the other party if there are circumstances that fall under one of the following:
1. Circumstances in which the travel agency may cancel
- When the conditions specified in Article 12, paragraph 1, items 1 or 2 occur.
- When the traveler causes inconvenience to other travelers or significantly hinders the smooth conduct of the trip.
- When the traveler becomes physically incapable of participating due to illness or other reasons.
- When the traveler fails to pay the travel fee by the specified date.
2. Circumstances in which the traveler may cancel
- When the conditions specified in Article 12, paragraph 1, items 1 or 2 occur.
- When a close relative within the third degree of kinship passes away.
- When the traveler becomes physically incapable of participating due to illness or other reasons.
- When the traveler’s spouse or immediate family member is hospitalized for more than three days and cannot be discharged before the trip departure date, in which case one caregiver is allowed to cancel.
- When the trip cannot be carried out as planned due to reasons attributable to the travel agency.
Article 14: Termination of Contract After Departure
① The travel agency or the traveler may terminate the contract after departure if there are unavoidable circumstances. However, they must compensate for any damages caused to the other party.
② If the contract is terminated according to paragraph 1, the travel agency must assist the traveler with necessary arrangements for their return, and any costs incurred due to reasons not attributable to the agency will be borne by the traveler.
Article 15: Start and End of the Trip
The trip starts from the time of departure and ends when the final destination is reached. However, exceptions apply when the contract or schedule is modified.
Article 16: Duty to Explain
The travel agency must explain the important contents and any changes in the contract in a manner that the traveler can understand.
Article 17: Insurance and Other Requirements
The travel agency must have insurance or a guarantee fund in place to compensate the traveler in case of any losses related to the trip.
Article 18: Miscellaneous
① Any matters not specified in this contract or disputes regarding the interpretation of this contract will be resolved by mutual agreement between the travel agency and the traveler. If an agreement cannot be reached, relevant laws and general practices will apply.
② If there are special circumstances for travel to specific regions, the provisions of this standard contract may be adjusted accordingly.
